Terms of Service

1. Acceptance of Terms

By accessing or using the Mr. Service platform at getmrservice.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Platform.

We reserve the right to modify these Terms at any time. Changes become effective when posted. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Mr. Service is a marketplace platform that connects homeowners and property managers ("Customers") with vetted home service professionals ("Providers") in the Columbia, South Carolina area. The Platform enables Customers to submit service requests, receive competitive quotes from Providers, communicate through secure messaging, and hire the professional of their choice.

Mr. Service is a marketplace facilitator, not a service provider. We do not perform any home services ourselves. We connect Customers with independent Providers and facilitate communication between them. Any agreement for services is solely between the Customer and the Provider.

3. Account Registration

To use certain features of the Platform, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Customer Responsibilities

As a Customer using the Platform, you agree to:

• Provide accurate descriptions and photos when submitting service requests
• Respond to Provider quotes and communications in a timely manner
• Honor commitments made to Providers through the Platform
• Pay for services as agreed upon with your chosen Provider
• Provide a safe and accessible work environment for the Provider
• Leave honest reviews and ratings after service completion

5. Provider Responsibilities

As a Provider using the Platform, you agree to:

• Maintain all required licenses, permits, and insurance for services offered
• Submit accurate and fair quotes for service requests
• Perform services professionally and in accordance with industry standards
• Communicate promptly with Customers regarding scheduling, changes, or issues
• Honor quoted prices unless changes in scope are agreed upon by both parties
• Comply with all applicable federal, state, and local laws and regulations
• Carry adequate general liability insurance for services performed

6. Quotes and Payments

Providers submit quotes through the Platform in response to Customer requests. Customers may accept, decline, or negotiate quotes. Once a quote is accepted, it constitutes an agreement between the Customer and Provider.

Mr. Service may facilitate payment processing through third-party payment providers. All payment disputes are between the Customer and Provider, though we may assist in mediation at our discretion.

Mr. Service may charge service fees to Providers, Customers, or both. Applicable fees will be disclosed before any transaction is completed.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Provide false, misleading, or deceptive information
• Harass, threaten, or abuse other users
• Circumvent the Platform to avoid fees (e.g., exchanging contact information to transact off-platform)
• Post spam, solicitations, or unrelated content
• Attempt to gain unauthorized access to other accounts or Platform systems
• Scrape, crawl, or use automated means to access Platform data
• Interfere with the proper functioning of the Platform
• Impersonate another person or entity
• Manipulate reviews, ratings, or bidding processes

8. Content and Intellectual Property

You retain ownership of content you submit to the Platform (photos, descriptions, reviews). By posting content, you grant Mr. Service a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform.

The Mr. Service name, logo, and all related marks, designs, and content are the property of Mr. Service and are protected by intellectual property laws. You may not use our branding without prior written consent.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MR. SERVICE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES OFFERED BY PROVIDERS, THE ACCURACY OF PROVIDER LISTINGS OR REVIEWS, OR THAT ANY TRANSACTION WILL BE COMPLETED SATISFACTORILY. While we vet Providers before they join the Platform, we do not supervise or control the actual services performed.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MR. SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, PROPERTY DAMAGE, OR PERSONAL INJURY RESULTING FROM SERVICES PERFORMED BY PROVIDERS.

IN NO EVENT SHALL MR. SERVICE'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO MR. SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mr. Service, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of the State of South Carolina, without regard to its conflict of law provisions.

Before initiating any formal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of thirty (30) days. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in Richland County, South Carolina, in accordance with the rules of the American Arbitration Association.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections relating to intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution survive termination.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
